The term “you” refers to the user or viewer of our website. By using this website, you acknowledge and signify that you have read, understood, and agree to be bound by these terms and conditions. If you do not accept and agree to these terms and conditions, you should not use this website.

Changes to these Terms and Conditions

DEB Exams may, at our discretion, change, supplement or amend these Terms and Conditions as they relate to your use for any reason, and without any prior notice or liability to you or any other person, by posting the modified Terms and Conditions on this website. You may not change, supplement, or amend these Terms and Conditions in any manner. You should check these Terms and Conditions for any changes any time you access this website. Each time you use this website you acknowledge and signify that you have understood and agreed to be bound by these Terms and Conditions as they then read.

Your account with DEB Exams

You may not transfer your account to another person, share it with anyone, or use it to impersonate anyone. You agree that you will provide us with accurate account information (such as your real name, valid email addresses, and accurate, non-fraudulent payment information). We may terminate your account if we are unable to verify or authenticate the information you provide to us. Accounts may only be created by individuals who are able to enter into legally binding and enforceable contracts.

Use of website

Users of this website must comply with all applicable laws. Persons in jurisdictions may not use this website where access to or use of this website or any part of them may be illegal or prohibited. If you breach any provision of these Terms and Conditions, you may no longer use the DEB Exams website. We may, at our discretion, refuse permission to access and use this website.

Any unauthorised use is strictly prohibited.

You may access and browse the DEB Exams website only using commercially available, SSL enabled web browser software. You agree that you will not use any robot, spider, other automatic device, or any manual process to monitor, copy, modify, distribute, or publish any web pages within this site or the content contained thereon without our prior written consent. You also agree that you will not frame any portion of the DEB Exams website without our prior written consent.

The scraping or data mining of the DEB Exams website or any of its content in any form and by any method is strictly prohibited.

With the exception for the refund and return policy described previously, DEB Exams provides their website and its contents on an “as is” basis. The warranty disclaimer and liability exclusion and limitation clauses survive indefinitely after the termination of this Agreement.

Confirmation of Communication with DEB Exams

Communications sent to DEB Exams by means of the DEB Exams website or email are not considered delivered or effective unless and until they are actually received and processed by a responsible representative from DEB Exams.

Cancellation Policy

We do not offer cancellation rights. Your contract commences at the time the order is received and you receive an email acknowledgement. This is when our production service starts. Regulation 6(4) of the EC Regulations 2001 (S.I. 207 of 2001) or Distance Selling Regulations is deemed to apply at this point and DEB Exams does not offer the right to cancel once the order has been made. Regulation 6(4) gives reasons for exceptions to the right to cancel e.g. for services if performance has begun with the consumers agreement before the cooling off period ends and / or for customised perishable goods.

Delivery

All paper orders and corrected scripts are dispatched to schools by courier only unless collection is requested. This allows for all parcels to be tracked online. We endeavour to dispatch all paper orders within five working days of receipt and to dispatch corrected scripts within eighteen working days of receipt.

Copyright Infringement

DEB Exams makes every effort to ensure that all necessary permissions have been obtained for material reproduced on the sites. You may report any claims or concerns (including copyright infringement claims) regarding the sites or their content by sending an email to info@debexams.ie.

Ownership of the DEB Exams Website

The DEB Exams website and its content (including all information in text, graphical, video and audio forms, images, icons, software, design, applications and other elements available on or through the web sites) are the property of DEB Exams and are protected by international copyright and other laws. No right, title or interest in any of DEB Exams' intellectual property are transferred to you by use of or access to this web site and you may not make any use of DEB Exams’ intellectual property, except as permitted under these Terms and Conditions. We reserve all rights to our web site.

Refund & Return Policy

Should you be dissatisfied with our papers, exam stationery or any correction an exchange, re-correction or refund may be offered at the discretion of DEB Exams once the Customer Service Department have been notified within five days of you receiving the goods, clearly stating the following:

• Your name, school name and the email associated with your account (where applicable).
• The user name under which you signed up (where applicable).
• The date on which you ordered the papers and/or exam stationery and/or corrections.
• The date on which you made your most recent payment.
• A detailed description of your reasons for requesting an exchange, re-correction or refund.

At the discretion of the management, an exchange, re-correction or refund may be applied. We will inform you in writing of the decision within five working days.

Privacy Policy

The DEB Exams website collects, uses and discloses your personal information in accordance with our Privacy Policy, which may be viewed by clicking this link. We may change the Privacy Policy from time to time at our discretion. Each time you use the website, you consent to our Privacy Policy as it then reads without any further notice or any liability to you or any other person.

Other Matters

These Terms and Conditions and all related matters are governed and interpreted in accordance with Irish law, and you consent to the non-exclusive jurisdiction of the Irish courts.

If any person of these Terms and Conditions is found to be unlawful, void, or for any reason unenforceable, then that provision shall be deemed to be severed from the rest of these Terms and Conditions and shall not affect the validity and enforceability of any remaining provisions. No consent or waiver by either party to or of any breach by the other party to these Terms and Conditions will be deemed or construed to be a consent to or waiver of a continuing breach or any other breach of these Terms and Conditions by that party. No consent or waiver will be effective unless in writing and signed by both parties. You expressly request and require that these Terms and Conditions be drawn up in the English language.

Any rights not expressly granted in these Terms and Conditions are reserved to DEB Exams. These Terms and Conditions are subject to change without notice.
